Act on Settlement Finality in Payment and Financial Instruments Settlement Systems   PDF 36 KB

This Act regulates settlement finality in the transfer order settlement systems and the effects of insolvency proceedings against a participant in a system on the rights and obligations arising from, or in connection with the participation of a participant in a system, as well as the rights of the holders of collateral security in the event of insolvency proceedings against the provider of collateral security.

  1. the conditions for the establishment, operation and dissolution of credit institutions with registered offices in the Republic of Croatia, as well as their prudential supervision;

This Act shall govern the status, operations, ownership status, powers and organization of the Croatian National Bank, as well as the relationship of the Croatian National Bank with the Republic of Croatia, banks and international institutions and organizations.
The Law was enacted on July 9, 2008.

  1. the conditions for the establishment, operation and dissolution of electronic money institutions with registered offices in the Republic of Croatia, as well as their prudential supervision; and
     
  2. the conditions under which persons or undertakings with registered offices outside the Republic of Croatia may issue electronic money in the Republic of Croatia.

"Payment system" shall comprise all payments in kuna among the participants in the payment system.
"Payment system" shall also comprise payments in other currencies among the participants in the payment system, as provided by law.
The participants in the payment system shall be defined as domestic business entities and individuals, as well as foreign juridical and natural persons (hereinafter referred to as: participants) pursuant to specific regulations.
Business entities shall be juridical persons, government authorities, government administration bodies, local and district (regional) government units and natural persons undertaking registered activity in accordance with the regulations.

Payment System Act

"This Act governs payment services, payment service providers, obligations of payment service providers to inform payment service users about the conditions for the provision of and about provided payment services, as well as other rights and obligations in relation to the provision and use of payment services, transaction accounts and the execution of payment transactions among credit institutions, the establishment, operation and supervision of payment institutions and the establishment, operation and supervision of payment systems. This Act shall be published in the Official Gazette and shall enter into force on 1 January 2011."
