The Committee for the Distribution of Financial Assets and Liabilities of the Former SFRY Referred to in Annex C to the Agreement on Succession Issues met at the Croatian National Bank on 24 November 2011. The meeting was chaired by Zdravko Rogić, authorised representative of the Republic of Croatia on the Committee.
The Committee started the meeting by addressing a procedural issue. This was in view of the fact that, with the exception of the representatives of the Republic of Slovenia, the Committee representatives of all the other the successor states to the former SFRY consider the Republic of Serbia and Montenegro to be the successor states to the Federal Republic of Yugoslavia (FRY) pursuant to the Agreement between the Republic of Serbia and the Republic of Montenegro governing the membership in international financial organisations and the separation of financial rights and obligations. The delegation of the Republic of Slovenia considers the Republic of Serbia the sole successor state to the FRY. Because of the unyielding stance on this issue taken by the delegation of the Republic of Slovenia, and in an effort to avoid the obstruction of its further work, the Committee agreed that a resolution to be adopted at this meeting should on behalf of the successor state FRY be co-signed by the representative of the Republic of Serbia and the representative of Montenegro, that it should also be signed by the representatives of the successor states to the former SFRY who agreed to such a solution and that a letter with a request that this solution be examined should be sent to the Government of the Republic of Slovenia.
The meeting continued with the Committee considering the manner of submitting the Proofs of Claim against the New York agencies of Jugobanka and Beogradska banka, joint venture banks holding the deposits of the National Bank of Yugoslavia of the former SFRY, whose assets were frozen since 30 May 1992, following the imposition of sanctions by the international community against the FRY), which have been in the liquidation proceedings since January 2002. This was due to the New York State Banking Department notifying the successor states, as creditors, that a procedure for submitting the Proofs of Claim in the liquidation of these Agencies was initiated on 22 July 2011. The deadline for submitting the Proofs of Claim against the New York agencies of Jugobanka and Beogradska banka is 22 January 2012. Given the fact that a joint stance on the amount of claim was reached, it was agreed that the successor states jointly submit their Proofs of Claim against the New York agencies of Jugobanka and Beogradska banka.
